Some Provisions Of Tanzania's Media Services Act Contravene EAC Treaty, Ruled EACJ
On March 28, 2019 the East African Court of Justice (EACJ) ruled that some provisions of Tanzania's Media Services Act, 2016, contravene the East African Community (EAC) Treaty signed in 1999. That was reported by some East African media on April 1, 2019.
More specifically and according to the reports, the regional bloc's court ruled that some sections of the Tanzania's Media Services Act, 2016, contravene Articles 6(d) and 7(2) of the EAC Treaty. The court cited the sections of the Tanzanian law that breach the EAC Treaty as Section 7(3) A - J as well as Sections 19, 20, 21, 35, 36, 37, 39, 40, 50, 52, 53, 54, 58, and 59.
The EACJ's ruling followed a hearing of a case brought to the court by, among others, Media Council of Tanzania, that accused the government of Tanzania of breaching freedom of expression through some provisions of the law in question. The hearing commenced in November 2017.
